Article 2 - Subject The subject of this agreement is the determination of the rights and obligations of the parties in accordance with the provisions of the Law No. 4077 on the Protection of Consumers and the Regulation on Distance Contracts regarding the sale and delivery of the product specified below, which the BUYER ordered electronically from the giveway.com.tr website of the SELLER, along with its features and sales price. The Buyer acknowledges and declares that they have been informed by the seller in a clear, understandable, and internet-compatible manner regarding the seller's name, title, full address, telephone, and other contact information, the basic characteristics of the product, including taxes, the sales price, payment method, delivery conditions, expenses, etc., all pre-information regarding the product subject to sale, the right of withdrawal, how to exercise this right, official authorities to which complaints and objections can be made, etc., that they have confirmed this pre-information electronically, and subsequently placed an order for the goods in accordance with the provisions of this agreement. The pre-information provided on the giveway.com.tr website and the invoice issued upon the order placed by the buyer are integral parts of this agreement.


Article 3 - Product/ Payment/ Delivery Information The type and quantity of the product/products purchased electronically, brand/model, sales price, payment method, recipient, delivery address, invoice information, shipping fee are as stated below. The person/company to be invoiced must be the same as the person/company who made the contract. The information below must be accurate and complete. The Buyer agrees to fully compensate for any damages arising from incorrect or incomplete information and further accepts any liability that may arise from this situation. If the Seller deems it necessary, in cases where the information provided by the BUYER does not match, the Seller reserves the right to stop the order. In cases where the SELLER detects a problem with the order, if the SELLER cannot reach the BUYER through the telephone, e-mail, and postal addresses provided by the BUYER, the SELLER will freeze the order for 15 (fifteen) days. The BUYER is expected to contact the SELLER regarding the matter during this period. If no response is received from the BUYER within this period, the SELLER cancels the order to prevent any damage to both parties.

Article 4 - Contract Date and Force Majeure The date of the contract is the date the order was placed by the buyer ../../.... Unforeseen circumstances arising outside the control of the parties, which were not present or foreseeable at the time of signing the contract, which partially or completely prevent one or both parties from fulfilling their obligations under the contract in a timely manner, such as force majeure (natural disasters, war, terrorism, rebellion, changes in legislation, seizure or strike, lockout, significant breakdowns in production and communication facilities, etc.), shall be deemed force majeure. The party affected by force majeure shall immediately and in writing notify the other party of the situation. During the continuation of force majeure, neither party shall be liable for the non-performance of their obligations. If this force majeure situation continues for 30 (thirty) days, each party shall have the right to terminate unilaterally.


Article 5 - Rights and Obligations of the Seller 5.1. The Seller undertakes to fulfill the obligations assigned to them in the contract under the Law No. 4077 on the Protection of Consumers and the Regulation on Distance Contracts, except in cases of force majeure. 5.2. Individuals under the age of 18 cannot shop on giveway.com.tr website. The Seller will rely on the age specified in the contract by the buyer. However, the seller shall not be held responsible for any inaccuracies in the buyer's age. 5.2. giveway.com.tr is not responsible for price inaccuracies resulting from system errors. Accordingly, the seller is not responsible for promotion, price errors that may arise due to interventions to the website's system, design, or illegal interventions. The buyer cannot claim rights against the seller based on system errors. 5.3. Purchases can be made from giveway.com.tr with a credit card (Visa, MasterCard, etc.) or bank transfer. Orders not paid by bank transfer within one week of the order date will be canceled. The timing of order processing is determined not at the time the order is placed, but at the time when the necessary collection is made from the credit card account or when the transfer (EFT) reaches the seller's accounts. Payment methods performed without consulting customer service, such as cash on delivery or postal check, are not accepted.


Article 6 - Rights and Obligations of the Buyer 6.1. The Buyer undertakes to fulfill the obligations assigned to them in the contract except for force majeure circumstances. 6.2. By placing an order, the Buyer is deemed to have accepted the terms of the contract and agrees to make the payment in accordance with the payment method specified in the contract. 6.3. The Buyer acknowledges and declares that they have been informed by the seller in a clear, understandable, and internet-compatible manner regarding the seller's name, title, full address, telephone, and other contact information, the basic characteristics of the product, including taxes, the sales price, payment method, delivery conditions, expenses, etc., all pre-information regarding the product subject to sale, the right of withdrawal, how to exercise this right, official authorities to which complaints and objections can be made, etc., and that they have confirmed this pre-information electronically. The Buyer also declares that they have read and understood the giveway.com.tr order/payment/use procedure information, which includes product order and payment conditions, product usage instructions, precautions taken for possible situations, and warnings, and provided the necessary confirmation electronically. 6.4. Accordingly, the Buyer, in the event of wanting to return the product, undertakes to return the product intact and undamaged, in accordance with the provisions of the right of withdrawal, within 14 (fourteen) days from the date of delivery.


Article 7 - Right of Withdrawal The Buyer has the right to withdraw from the contract within 14 (fourteen) days from the date of delivery of the product to the person and/or the person/company at the address indicated. The Buyer must notify the Seller by phone, fax, or e-mail about their intention to exercise their right of withdrawal within the time specified above. However, products that have been specially prepared for the Buyer, customized, or altered according to their wishes or needs, underwear, swimwear, etc., whose protective elements such as hygiene, health, etc., have been removed or violated after delivery, and products that have lost their qualification to be resold due to deterioration or expiry of their shelf life are exempt from the right of withdrawal.

Article 9 - General Provisions 9.1. The buyer accepts, declares, and undertakes that they have read all the articles and provisions of this agreement and have received sufficient information. 9.2. In case of disputes that may arise from this agreement, the Consumer Arbitration Committees and Consumer Courts at the Buyer's residence or where the purchase is made shall be authorized. 9.3. This agreement consists of 9 (nine) articles and entered into force by the parties upon mutual agreement.


In the event of any dispute, the Istanbul Consumer Arbitration Committee and Istanbul Courts will be authorized. This contract was prepared in Turkish and translated into English. In case of a dispute, the Turkish text will be taken into account.
